TERMS OF USE AGREEMENT (TERMS AND CONDITIONS) FOR PARTICIPATING IN OUR ONLINE AUCTION

Two Old Souls, Inc., is an affiliate of the J&K Estate Sales Auction Platform but operates as an independent, incorporated small business in Ohio.

Once You place a bid, You enter into a legally binding agreement that is enforceable by law in Ohio. Please read carefully before bidding. To read a more detailed version of the Terms & Agreement, click the "Terms & Agreement" link at the top right of the page.

"We" refers collectively to Two Old Souls, Inc. and/or J&K Estates Sales LLC unless otherwise stated. The terms "Winners/Buyers/Winning Bidders/Customers" and "Items/Lots/Assets" are used interchangeably for purposes of this document. "Website" is used interchangeably with 'Platform or "Auction Platform". Unless otherwise noted, "You/Your" refers to the Bidder/Buyer/Winner. Two Old Souls, Inc. is a privately held corporation affiliated with J&K Estate Sales, its own operating legal entity/business. J&K Estate Sales LLC and Affiliates are all licensed and bonded in favor of the State of Ohio.      

You are solely responsible for all Your activities on the Website, including Your behavior and any content You submit, post, or share. You may not use the Website/Platform for unauthorized or illegal purposes. Also, by using this Site, agree that You are NOT to copy, reproduce, or publicly display any content (intellectual property including logos, photos, descriptions names, etc.) from the Website outside its intended functions without first obtaining written permission from J&K Estate Sales and/or the Auction Manager (Two Old Souls, Inc. Online Auctions). It is Your responsibility to ensure that You comply with the laws in Your jurisdiction. You also agree not to upload or transmit any viruses, worms, or other destructive code.                                                                                     

1. BUYERS' PREMIUM: 12%

2. REGISTRATION: Bidders must enter a valid credit card (Visa, MasterCard, Discover, or American Express) with the required contact information, including name, address, valid email address, and phone number. Note: We do not automatically charge credit cards for invoiced amounts after the auction closes – the winning Bidder must initiate and process any charge to their card for payment.

You MUST be an Ohio resident to bid on a vehicle and other titled Assets, unless approved by the Auction Firm Manager or Auctioneer (Two Old Souls, Inc., Online auctions) in advance. Out-of-state Bidders must contact the Auction Firm's Manager or Auctioneer before bidding on titled assets; the Platform Administrator will grant or deny approval on a case-by-case basis. All firearms must be purchased by an Ohio resident 21 years or older, who must present valid Ohio identification at the time of pickup. All firearms MUST be collected on the day of pickup - NO EXCEPTIONS - as you must take possession/receive the firearm(s) directly from their original owner, per auction rules.

3. PAYMENT: Shortly after an auction concludes, the Winning Bidders will receive an invoice via the auction Platform. Winners can pay online using a credit or debit card through Stripe on the J&K Estates Auction Platform or via Square on pickup day. As a courtesy to our Customers, we cover any credit card processing fees charged by third parties. Cash will only be accepted at pickup; please use only small bills. Checks are not accepted at any time.

4. SALES TAX: Two Old Souls, Inc. Online Auctions adds a 7% sales tax (Portage County) to every transaction on some auctions. The auction summary will clearly state that we are charging sales tax for the auction when applicable.

5. BIDDING ERRORS: Please be aware that many Bidders routinely increase their bids to price an item out of reach of other Bidders. Be sure to review ALL bids before submitting them, as we WILL NOT reverse bids that have caused another Bidder to be outbid or if a Bidder places a bid on the wrong item. We WILL NOT reverse any bids after the auction has begun to close, with no exceptions.

6. MAXIMUM BIDS: We usually use only one bidding field. Many Bidders submit their "maximum bids" as they appreciate the convenience and do not want to miss out on a bidding opportunity by placing only real-time bids, especially in an auction's final, frantic minutes. Please note that max bids and lot reserves are not disclosed.

If someone bids against You, the Platform Software will place Your bid at the maximum You have assigned. If You are immediately outbid when that bid is placed, You are most likely up against someone else's max bid. Be sure to click "REFRESH LINK" frequently to ensure You view the most up-to-date data.

7. GROSS BIDDING ERRORS: Any gross errors must be reported immediately via phone call to (330) 283-0571. They will be handled on a case-by-case basis and at the sole discretion of J&K Estate Sales LLC and Two Old Souls, Inc., Online Auctions, who are not obligated to make a reversal but will have the final decision on how to proceed.

8. STAGGERED CLOSING: Online auctions on this Platform close one to two Lots at either one-minute or 30-second intervals (see the "Duration" section of each auction).

9. DYNAMIC CLOSING: An Asset's closing time is automatically extended by an additional two minutes whenever a new bid is placed within the last two minutes of the Asset's closing time, allowing other Bidders to place their final bids. This process will continue until bidding on a Lot or Item is no longer active.

10. REMOVAL: This is an ONLINE-ONLY AUCTION. Please DO NOT bid if You cannot pick up Your Items/Lots during the indicated removal time. Please be aware that REFUNDS OR CHARGEBACKS WILL NOT BE GRANTED. Winners are responsible for removing Assets at their own expense, liability, and risk. Winners are responsible for removing all Items from each Lot. The Auction Company Staff does not provide moving services or tools. Please be prepared to remove all Items from the property first, then sort and pack them.

11. PICKUP OF ASSETS:. Winners will check in with the Cashier to verify payment and, if necessary, pay in full. Afterward, they will receive a copy of their invoice. All Bidders agree to be held personally responsible for all purchases made under their Bidder number or account. Items not picked up during the published removal times will incur a disposal fee. The Buyer authorizes J&K Estate Sales LLC and Two Old Souls, Inc., Online Auctions to release the Buyer's Assets to any individual possessing the Buyer's sales receipt. 

Buyers may be required to produce ID for security reasons. Please have your ID with you at all times at pickup. All Buyers who pick up may be electronically recorded and monitored, whether or not it is disclosed.

The Winner's invoice will list the exact property address and any special instructions. During the live online auction, only the general location of the property will be disclosed in the auction details for the property owner's safety and security.

12. WARRANTY & CONDITION OF ITEMS SOLD: All items are sold "AS IS, WHERE IS, with NO WARRANTY expressed or otherwise implied.

Please read the description and carefully review the Lot images before placing your bid. Shipping is not available unless otherwise stated in the Asset listing.

Descriptions are believed to be accurate but are not guaranteed. The photos are part of the description; always refer to them (and your eye) as the default description, as photos may show wear that is not mentioned in the written description. We do our best to describe and photograph the Items in each Lot to show any wear or defects; however, a perception of a "flaw" can vary from person to person. 

We use Google Lens to verify the authenticity of certain Items by comparing them with other online sources, particularly for vintage Items or those without clear markings. While Google Lens is usually accurate, occasional errors may occur. Therefore, please conduct thorough research before submitting a bid. We also utilize AI to generate backgrounds for the first photos, leaving the others in their natural state. Please carefully review all pictures of the Items to ascertain their condition and verify listed measurements, when applicable.

When unsure of the condition or brand, please bid accordingly. J&K Estate Sales LLC and Two Old Souls, Inc. Online Auctions are not responsible for using or misusing items, infestation and pathogens, environmental or toxic harm, or any injury or harm caused by items purchased. 

13. BUYER DEFAULT: After the scheduled removal, Items not picked up will be considered abandoned. We may charge your credit card or invoice you for a disposal fee if the Lots are not picked up or the Items are left behind at the property. If a Bidder defaults at an auction, it may, at its discretion, contact the backup Bidder(s) for an offer; however, it is not legally obligated to do so.
